Again we're missing an identified release criterion failure here, but I suppose it's obvious enough: "All elements of the default panel (or equivalent) configuration in all release-blocking desktops must function correctly in typical use."

Yeah, we tend to treat the overview and the top-right menu as the equivalent of 'panel' for that criterion, so I think it's reasonable to apply that one here.
